This website, lovingvow.com, is operated by LUMENEU L.L.C., trading as LovingVow (“LovingVow”, “we”, “us” or “our”), 1309 Coffeen Ave STE 1200, Sheridan, WY 82801, United States. By visiting our website or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the website.

Using our website

You may use our website to browse and buy our products for your personal, non-commercial use. You must be at least the age of majority where you live, or have the permission of a parent or guardian, to place an order. You agree to provide accurate, current information when you order, including your name, email, shipping address and payment details.

Our products

We do our best to describe and photograph our products accurately. Our necklaces are made of alloy with a zircon centre stone and are offered in silver or gold color; they are not sterling silver, solid gold or real diamonds. Lifestyle photos on our website are styled for illustration. The product photos and description on the product page show what you will receive. Colors may look slightly different depending on your screen, and small variations in finish can occur.

The printed message card included with your necklace carries the wording shown on our website. Custom card wording is not currently offered.

Prices and payment

All prices are shown in US dollars unless your checkout shows another currency. Prices include the product only; any applicable taxes, duties or shipping charges are shown at checkout or explained in our Shipping Policy. We may change prices at any time, but a change will not affect an order we have already confirmed.

Payment is processed securely through Shopify and its payment partners. We do not see or store your full card details.

Orders

Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may refuse or cancel an order, or limit quantities, for example if a product is unavailable, if there is an obvious pricing or listing error, or if we suspect fraud. If we cancel an order after you have paid, we will refund you in full.

Shipping and delivery

Delivery times, shipping costs, customs duties and what happens if an order is late or lost are explained in our Shipping Policy. Delivery estimates are not guaranteed.

Returns and refunds

You may request a return within 15 days of receiving your order, as explained in our Refund Policy. Our Refund Policy forms part of these terms.

Gifts

If you send your order directly to someone else, you remain the customer for the purposes of returns, refunds and these terms.

Reviews and content you send us

If you send us a review, photo, comment or other content, you confirm that it is your own, honest and lawful, and you allow us to display it on our website and marketing. We may remove any content we consider unlawful, offensive or misleading.

Intellectual property

All content on this website, including text, photos, graphics, the LovingVow name and logo and the message card design, belongs to us or our licensors. You may not copy, reproduce, sell or use it commercially without our written permission.

Acceptable use

You agree not to:

  • Use the website for any unlawful or fraudulent purpose
  • Attempt to interfere with, damage or gain unauthorized access to the website or its systems
  • Upload viruses or harmful code
  • Collect other users’ information or use automated tools to scrape the website
  • Impersonate any person or misrepresent your connection to us

Our website uses third-party services, such as Shopify for the store and checkout, payment providers and delivery carriers. Their own terms and privacy policies apply to their services, and we are not responsible for them. Links to other websites are provided for convenience only.

We work to keep the website accurate and available, but we do not guarantee that it will always be error-free, uninterrupted or secure. Apart from the commitments in these terms and our policies, and to the extent the law allows, the website and products are provided “as is”.

Limitation of liability

To the extent the law allows, LovingVow will not be liable for any indirect or consequential loss, or for any loss of profit, data or opportunity, arising from your use of the website or our products. Our total liability for any order will not exceed the amount you paid for that order. Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

Indemnity

You agree to compensate us for any claims, losses or costs that result from your breach of these terms or your misuse of the website.

Privacy

Our Privacy Policy explains how we collect and use your personal information, and forms part of these terms.

Your consumer rights

Nothing in these terms affects your statutory rights as a consumer. If you live in the European Union or the United Kingdom, you keep the protections of the consumer laws of your country of residence, including your right to withdraw from a purchase within 14 days of receiving it.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, without affecting any mandatory consumer protections that apply where you live. Any dispute will be handled by the courts of Wyoming, unless the law of your country gives you the right to bring a claim in your local courts.

Changes to these terms

We may update these terms from time to time. The version shown on this page, with its “Last updated” date, applies to every order placed while it is shown. Changes will not affect orders already placed.

General

If any part of these terms is found invalid, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. These terms, together with our Refund Policy, Shipping Policy and Privacy Policy, are the entire agreement between you and us about your use of the website and your orders.
